Zaliplay operates as an online service provider under the safe-harbor provisions of the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512) and analogous international notice-and-takedown frameworks. This policy describes our IP enforcement procedures and your obligations as a uploader.
SECTION 1: SAFE HARBOR DESIGNATION
- 1.1
HOSTING STATUS: Zaliplay does not proactively monitor all user uploads. We act as a neutral hosting and delivery intermediary, responding to valid rights-holder notices and repeat-infringer policies.
- 1.2
NO IMPLIED LICENSE: Uploading content does not grant Zaliplay ownership. You represent that you hold all necessary rights, licenses, and permissions for every asset you publish.
SECTION 2: DMCA TAKEDOWN NOTICE REQUIREMENTS
To submit a copyright infringement notification, your written notice must include:
- 2.1
Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are covered.
- 2.2
Identification of the infringing material and sufficient information for us to locate it (URL, content ID, or live-stream timestamp).
- 2.3
Your contact information, a good-faith statement of unauthorized use, a statement under penalty of perjury that the notice is accurate, and your physical or electronic signature.
- 2.4
Send notices to: DMCA Agent, Zaliplay Legal, dmca@zaliplay.com.
SECTION 3: COUNTER-NOTIFICATION & RESTORATION
- 3.1
If you believe content was removed in error, you may submit a counter-notification including your signature, identification of removed material, a perjury statement of good-faith belief, and consent to jurisdiction.
- 3.2
We may restore content after ten (10) to fourteen (14) business days unless the complainant initiates court action.
SECTION 4: REPEAT INFRINGER & PLATFORM REMEDIES
- 4.1
REPEAT INFRINGER POLICY: Accounts accruing three (3) or more upheld infringement strikes within twelve (12) months face permanent termination and forfeiture of pending non-withdrawn balances subject to Terms of Service.
- 4.2
QUARANTINE & JURY REVIEW: Flagged content may enter jury dispute review before public restoration. Monetization on quarantined assets is suspended.
- 4.3
FALSE CLAIMS: Knowingly submitting materially false infringement notices may expose the submitter to liability under 17 U.S.C. § 512(f).
